Tecumseh Athletic Boosters Club
Regulations & By Laws
Revised May 2002
Article I
This organization shall be known as
"Tecumseh Athletic Boosters Club" and shall be an organization
not for profit.
Article II
It shall be the purpose of this
organization to stimulate community interest and cooperation in the
Tecumseh Local School District. (Tecumseh High School, New Carlisle and
Olive Branch Middle Schools) Interscholastic athletic activities.
Interscholastic activities are defined as those activities sanctioned by
the Ohio High School Athletic Association.
Article III
Section 1 - Members
Any person, eighteen years of age or older,
residing in the Tecumseh Local School District, or any individual having
students in the Tecumseh Local School District and or any alumni of the
Tecumseh Local School District shall be eligible for membership.
Section 2 - Membership Dues
The cost of membership shall be $10 per
family per year.
Article IV
Section 1 - Annual Meeting
The annual meeting of the organization
shall be held on the regularly scheduled May meeting at Tecumseh High
School.
Section 2 - Regular Meetings
The regular meeting of the organization
shall be scheduled monthly. The dates will be established at the Annual
meeting held at the Tecumseh Campus.
Section 3 - Special Meetings
Special meetings may be called by the
President, Vice President or other officers as deemed necessary. Amend 5/6/02 from five dollars to the ten
dollars.
Section 4 - Notice of Meeting
Notice of any meeting of the organization
shall be given by publication through the media, by mail or by oral
communication.
Section 5 - Quorum
Five members, including not less than two
of the elected officers or trustees, shall constitute a quorum of
any meeting of the membership of the organization.
Section 6 - Voting Rights
Each member shall have the right to one
vote on each matter properly submitted to the members for their vote,
consent, waiver release or other action.
Article V
Officers - Trustees
The officers of the organization shall be
President, Vice President, Secretary, Treasure and a minimum of seven
Trustees, who shall be elected at the annual meeting of the membership to
serve until the next annual meeting. All officers and trustees must be
members of the organization. All officers and trustees must attend a
minimum of five regularly scheduled meetings to maintain their elected
status. Failure to meet these attendance requirements may be considered
grounds for non-renewal.
Article VI
Nomination & Election of Officers and Trustees
Prior to the annual meeting the President
shall appoint a Nomination Committee consisting of not less than three
members to nominate officers and trustees. The membership shall have the
right to make additional nominations for any office or trustee at the
annual meeting or any special meeting called for the purpose of electing
officers. Vacancies shall be filled by majority vote of those members
present and voting the unexpired term. Amended 5/26/98 - added in its entirety
Article VII
Officers Duties and Responsibilities
Section I - President
The President shall preside at all meetings
of the members; shall appoint all special committees as is deemed
necessary and all other powers and authorities herein granted or as may be
hereinafter granted by action of the members; have control over the right
to possession of and duty to maintain all official books of record; shall
have authority to act for an don behalf of the organization involving the
raising of or the expenditure of not more than one thousand dollars
($1000).
Section 2 - Vice President
The Vice President shall perform the duties
of the President in his/her absence.
Section 3 - Secretary
The Secretary shall preside at all meetings
of the members in the absence of the President and Vice President. The
Secretary shall record all minutes of the meetings in a durable record
book, prepared and furnished for that purpose, issue notice of meetings
for and in the manner prescribed in Article IV - Section 4 - Notice of
Meetings; and shall keep such other records as are proper and necessary.
Section 4 - Treasure
The Treasure shall receive all monies and
the same shall be disbursed under the direction of the membership and in
accordance with these regulations and by -laws. Proper vouchers shall be
taken for all disbursements. It shall be their duty to keep an accurate account
of the finances of the organization in a durable
record book, prepared for that purpose. to render an account of the finances
of the club at each regular meeting. At the expiration of their term of
office shall deliver all money, property and rights of the club in their possession
to their duty elected successor in office. An Audit Committee of
three members shall be appointed by the President to examine the
Treasure's accounts annually and report the status of the same to the
membership at its annual meeting.
Section 5 - Athletic Director
The Athletic Director will perform the role
of liaison between the Athletic Department and the club. He/she will
communicate department needs and school board policy to ensure the club is
functioning in the best interest of the Athletic Department.
Article VIII
Impeachment - Officers
Any officer can be removed from office by
2/3rds of those present and voting members.
Article IX
Order of Business
Unless this regulation is suspended by a
majority vote of members present at any meeting, the order of business at
all meetings shall be conducted according to Robert's Rules of Order.
Article X
Dissolution
Upon legal dissolution of this organization
any funds or property remaining shall become the property of the Tecumseh
Local Schools for use by the Tecumseh Athletic Department.
Article XI
Amendments
The regulation and by-laws may be amended,
supplemented, or repealed by majority vote of all members present and
voting at a special meeting called for that purpose or any annual meeting
of the members. This being a non-profit charitable organization, no
amendment shall be adopted which shall or may terminated the charitable,
non-profit status of the organization.
Article XII
General Provisions
Nothing in the regulations and by-laws of
this organization nor the articles of incorporation shall be construed in
any manner whatsoever, as giving the organization of officers the right to
assume or interfere with rights, powers and duties, or to dictate the
policies of the administration and/or school Board of the school district.
The organization is not intended to replace, infringe upon or interfere
with any other existing organization. It is the stated desire and
intention of this organization to work in harmony with the administration,
the School Board, and all other organization for the welfare and benefit
of the entire school district.
Article XIV
Finance
The following guidelines will be adhered to
in all financial matters:
1.) The club will maintain a minimum of to
bank accounts:"
a.) Regular Boosters fund account
b.) Athletic Department fund account
2.) Formal reports will be made to the membership at its regular meetings.
3.) Disbursements in excess of one thousand dollars will be approved by
membership vote.
4.) (Omitted per amendment dated 5/28/96 - see below)"
5.) All requests for funds are to be made through the Athletic Director.
6.) All deposits will be made to the proper accounts by either the
Athletic Director or the Treasure, or by any designed person(s)
approved by majority vote at any regularly scheduled meeting."
Amend 5/28/96 from "the club will
maintain to bank accounts"
Amended 5/28/96 - Eliminated "The President and Treasurer shall be
bonded for a total of fifteen thousand dollars.
Amended 5/6/02 from "All deposits will be made by the Athletic
Director to the proper account."
